Injunctive Relief

After seeking to negotiate a settlement with its landlord, our client was locked out overnight with locks changed and a new tenant proposed to be installed.

Within 24 hours our team urgently instructed counsel, prepared a summons, a detailed affidavit in support of our client’s equitable lease and approached the Supreme Court Duty Judge at 6pm on Friday to obtain emergency injunctive relief.

The Judge was critical of the landlord resorting to self-help and, at a relisted hearing before his Honour Justice Lindsay a week later, our client was successful in securing orders allowing it to re-enter the property with a restraint on the landlord and new tenant from further interference.

Ultimately, our client used the additional time in the property to negotiate a favourable settlement with all parties from a position of strength.
